Albania has two crypto regulators:
AMF(3) (Financial Supervision Authority), which is competent for the evaluation of financial and regulatory aspects. NAIS(4) (National Agency of Information Society), which is competent for the evaluation of the applicant's technological capacities during the licensing process.
Albanian Financial Supervision Authority has approved (5) a licensing regime for crypto exchanges in 2020.
However, only in November of 2022, the AMF Board approved (6) the first two crypto regulation legal acts - "On capital adequacy and own funds of entities operating in financial markets based on distributed ledger technology" and " For the licensing of subjects that exercise the activity as a digital token agent". The law will apply to digital currency exchanges that use blockchain’s distributed ledger technology to hold digital tokens and assets.
Under the newly introduced licensing regime, DLT exchanges will fit under one of three categories: those that use just digital assets and digital tokens, those that use fiat and virtual currency, and those that trade digital securities. The licenses will be issued based on submitting detailed documentation, including company organization, business plans, source of capital, and reputation.
